Description

Suit was commenced by the plaintiff Renate Wulf, a passenger in an auto driven by defendant Rodger Rebbun, to recover for
personal injuries sustained when the Rebbun car collided with an auto driven by defendant Bernard Yenter. The defendant United
Services Automobile Association insured Rebbun and Farmers Insurance Exchange insured Bernard Yenter. The American Motors
Corporation was made a defendant because of the alleged negligence of an employee. The drivers and their insurers cross-complained
against American Motors which demurred to the complaint and to the cross complaints. The court sustained the demurrers and
the appeal is taken from the judgments dismissing the cross complaints. The complaint alleges that on April 3, 1962, about 7:10 a.m. the defendant Rebbun's car was proceeding north on North Holton
street in the city of Milwaukee; that the defendant Yenter was traveling west on an alley which meets North Holton street
in the 2900 block and when Yenter arrived at the intersection an employee of American Motors Corporation whose truck was parked
at the east curb of North Holton street just south of the alley carelessly and negligently signaled to Yenter to proceed.
Yenter proceeded out of the alley onto North Holton street and then turned in a southerly direction and collided with Rebbun.
